Section 18(6) of the 1999 Act bans nuclear generation; the Planning and Development Act 2024 restates it. The ban has held throughout and holds still. But it forbids making nuclear power, not importing it — and in 2028 the Celtic Interconnector links Ireland to France’s 70%-plus nuclear grid, the year a repeal bill reaches the Dáil and public support sits at 32%.

The ban is total, and doubly locked.

Section 18(6) of the Electricity Regulation Act 1999 states that no order under it may “provide for the use of nuclear fission for the generation of electricity”; section 16(1) bars building a generating station without a CRU authorisation the Act will not grant for nuclear. The Planning and Development Act 2024 adds a second, explicit prohibition, providing that nothing in it authorises a nuclear-fission generating installation. Two statutes, one answer: no nuclear generation in Ireland. This is not a policy a minister could change by regulation; it is primary legislation, and undoing it requires the Oireachtas to pass a new Act. That is a high bar, and it is why the debate this report describes is, for now, about whether to start a legislative process — not about building anything.

The prohibition covers generation only. It does not stop Ireland consuming nuclear-origin electricity imported over interconnectors, nor does it touch research or medical uses of nuclear technology. The law draws its line precisely at the point of generation within the State — and enforcement, by definition, stops at the border. This is the distinction on which the whole paradox turns: Ireland can and does buy electricity from grids that run on nuclear power, and will buy more once Celtic opens, all entirely legally, because the ban is on making it at home, not on using it. The Electricity Regulation (Removal of Nuclear Fission Prohibitions) Bill 2026, a Private Member’s Bill from Fianna Fáil TD James O’Connor, has been drafted and is due for Dáil debate (RTÉ, 3 May 2026). It would repeal the 1999 ban and the related 2024 provision, authorising nuclear generation. Whatever its fate — as a backbench bill without Government adoption, its likeliest outcome is debate and referral rather than enactment this term — the ban is being formally challenged in the Oireachtas for the first time in decades. That is a genuine inflection in a settled national position, and the concrete event that moved nuclear from a fringe topic to a live parliamentary one. Its real significance is less in its likely passage than in what its debate reveals about where the parties, and the public, now stand.
